The US Environmental Protection Agency (USEPA) published a final rule July 12, 1989, under the Toxic Substances Control Act (TSCA) to ban most asbestos-containing products, including asbestos-cement (A-C) pipe. Upon appeal, the rule was invalidated and sent back to USEPA Oct. 18, 1991, by the US Court of the Appeals of the Fifth Circuit. The history and implications for water utilities of this and subsequent actions by USEPA regarding asbestos are reviewed. Includes 9 references.
