Definitions
In this Condition, the following terms shall have the following meanings:
a. ‘Authority' means the Secretary of State for Defence, or Representative of the Authority, who has contracted for the Towing and / or Salvage Services;
b. ‘Contractor' means the individual or company that owns, operates or manages the chartered vessel from which the Towing and / or Salvage Services are provided;
c. ‘Live Ammunition Asset' means any non nuclear live weaponry belonging to the Authority or for which the Authority is legally responsible;
d. ‘Loss or Damage' means damage to the Contractor's own vessel including physical loss and destruction but excluding any indirect or consequential loss;
e. ‘Nuclear Asset' means any nuclear powered submarine, nuclear weapon or special nuclear material belonging to the Authority or for which the Authority is legally responsible;
f. ‘Personal Injury' means any personal injury including death;
g. ‘Representative of the Authority' in any provision of the Contract means the person duly authorised by the Authority to act for the purposes of the provision and identified in the Contract or in any subsequent notice to act for the purposes of the provision;
h. ‘Salvage Services' means any act or activity undertaken to assist a vessel or any other property in danger in navigable waters or any other waters whatsoever1;
i. ‘Services' means all services which the Contractor is required under the Contract to perform or to fulfil;
j. ‘Subcontractor' means any subcontractor engaged by the Contractor or by any other subcontractor of the Contractor at any level of subcontracting to provide goods, services or works in or towards fulfilment of any obligation on the part of the Contractor under the Contract;
k. ‘Towing Services' means Services for the towing of one or more vessels of any nature, including anything carried on the vessel(s);
