This business process applies to all business units within Network Rail involved in the planning, design and management of construction work under the CDM Regulations.

The CDM Regulations apply to the whole process on all construction projects from concept to completion, including ongoing maintenance. Any person made responsible for planning, instigating, sponsoring or delivering any works on Network Rail managed infrastructure, which would include construction and/or maintenance work activities, should decide the extent to which the CDM Regulations apply.

It should be read in conjunction with those regulations and the HSE guidance on the CDM Regulations (L153 Managing health and safety in construction).

This business process applies to the CDM Regulations that apply to construction projects as a whole – that is, the whole construction process from concept to completion.

It does not cover Part 4 of the CDM Regulations. Part 4 is addressed by other Network Rail standards and suppliers’ management arrangements.

It does not elaborate in detail on the requirements of the Application of the Common Safety Method for Risk Evaluation and Assessment.

NOTE 1: Network Rail is a railway duty holder and is required to use the CSM-REA method for risk assessment, as specified in the Railways and Other Guided Transport Systems (Safety) Regulations (ROGS 2006, as Amended). As part of this process a Hazard Record shall be produced. Network Railhas specified the process for application of CSM-REA in NR/L2/RSE/100/02.

NOTE 2: A project hazard record as required under CSM-REA could be used to identify hazards that need to be controlled by suitable and sufficient risk assessment

NOTE 3: Part 4 is General requirements for all construction sites.

NOTE 4: For outside party interfaces the external client is accountable for adherence to CDM: part 4.

Purpose

This business process sets out the requirements and principles to be implemented by Network Rail to enable compliance with the legal requirements of the Construction (Design and Management) Regulations 2015 (CDM Regulations).

NOTE: Complying with the CDM Regulations does not remove the need for a business unit to comply with other health and safety legislation appropriate to the hazards and work activity, including, for example, hazard identification and undertaking risk assessment according to the Management of Health and Safety at Work Regulations 1999, and provide a safe system of work according to the Health and Safety at Work etc. Act 1974
