This Network Rail standard specifies the arrangements to be applied where enforcement action is served on the company, including where the enforcement action may be served locally.
This standard applies to all Network Rail Functions.
This standard applies to all health and safety enforcement action served on Network Rail by the Office of Rail Regulation (ORR), the Health and Safety Executive (HSE), Environment Agency or other enforcing authority in respect of:
a) operations or activities on or affecting Network Rail Managed Infrastructure (NRMI), including managed stations;
b) not on or affecting NRMI but related to Network Rail's:
• operations or activities,
• owned or leased buildings, equipment and vehicles.
Note 1 The requirement to report such enforcement action is not restricted to actual operations on or affecting NRMI, but includes enforcement action issued in respect of, for example, changes to or failure to comply with the organisation's health and safety management system (H&SMS).
Purpose
To require that any enforcement action served on Network Rail is:
a) processed expeditiously and
b) its contents evaluated in order that appropriate action is taken and, in the case of Prohibition and Improvement Notices, the risk of further enforcement action (i.e. a summons) is reduced or eliminated.
