This procedure shall apply to all physical works projects managed or funded by Network Rail which take place outside the scope of an infrastructure maintenance contract and which could introduce risk to the Operational Railway and/or third parties and includes the application of the Construction (Design and Management) Regulations 1994 (the CDM Regulations) to such projects, as described in Network Rail's Railway Safety Case.

It does not apply to "Third Party works" as described in Company Standard RT/LS/P/043, or to "Outside Party works" which are covered by separate Asset Protection Agreements. For other physical works projects the applicable sections should be considered as best practice.

It is to be read in conjunction with HSSM Procedure NR/SP/OHS/00108 "Contract Safety and Assurance Requirements" which covers the safe management of the contracted elements of a project and the HSE Approved Code of Practice (ACOP) "Managing Health and Safety in Construction" which shall be the principal source of guidance for the application of the CDM Regulations to Network Rail's works.

Purpose

This procedure describes the activities required to ensure the safe management of Network Rail projects as required by component 9 of the Network Rail Safety Management System.
