This document shall apply to Network Rail, Contractors, Suppliers and Leasees involved in the management of Network Rail Standards. It shall also cover the management of Railway Group Standards in so far as Network Rail is concerned.

Guidance Notes and Codes of Practice are exempt from the requirements of this document.

Standard Functional Procedures are exempt insofar as any non-compliance shall be against the over-arching Network Rail Standard.

This Standard applies to any requirement of a Railway Group Standard or Network Rail Standard where management identifies that either:

• It is demonstrably not reasonable to comply with a standard for a predetermined period of time or;
• The Standard is considered inappropriate, out of date or is being challenged or;
• The existing management arrangements are considered equivalent or better than those required by the Standard.

Application for derogation against Technical Specifications for Interoperability (TSIs) shall be made using separate procedures contained in this standard.

Purpose

This Business Process Document defines the procedures by which non-compliance authority for Railway Group Standards and Network Rail Standards shall be managed within Network Rail. It also provides for derogation to Technical Specifications for Interoperability.

The process is managed electronically through the Approved Network Rail Compliance Database. This monitors applications, reviews, further information sought and supplied and authorised with conditions wherever required.

This Business Process Document shall support Network Rail Company Standard NR/CS/STP/001 - Managing Network Rail Standards (formerly RT/LS/P/001).
