This standard serves for the practical implementation of the requirements regarding legally compliant operation of real properties (estates, buildings, structures) and BS installations. It shall be applied together with the other parts of the VDI 3810 series of standards. The entrepreneur and other proprietor of a company or business shall execute proper supervision to prevent any breach of duty (Section 130 Subsection 1 of the German Administrative Offences Act (OWiG)). This duty of supervision can be performed only if legal knowledge of the duties to be observed is available. Figure 1 provides an exemplary overview of operator's responsibility.

This standard supplements the standard VDI 3810 Part 1.

The requirements for compliance with specified normal operation imply that the operator's responsibility is embedded in a system of comprehensive performance of the operator's duties. The requirements ensuing from the operator's responsibility are:

• communication between top management and managers

• compliance with acknowledged rules of technology/ the state of the art

• supervision of performance

• documentation

Particular spheres of responsibility include:

• occupational health and safety law

• legal duties to maintain safety

• public law

• environmental law

• criminal law

• energy law

A company's organisational and process planning is the overall result of deliberate, joint actions involving:

• infrastructural facility management (FM)

• commercial FM

• technical FM

• top managers/heads of authorities

The standard addresses all persons in charge of operating, in particular:

• owners

• possessors

• entrepreneurs and other proprietors

• heads of authorities

• planners

• installers (see VDI 6039)

• managers and agents

• service providers and other third-party companies

• building and property managers

• tenants
