This standard outlines the way in which Network Rail’s works in the street/road are to be co-ordinated and applied for. It sets out the data required, from whom, when and how it will be submitted.
In Scotland this includes the dissemination within Network Rail of the schedules of road works of other parties that may affect the condition and/or operation of Network Rail.
Purpose
Network Rail’s infrastructure interfaces with streets managed by more than 200 Highways Authority (HA).
The purpose of this standard is to mitigate against conflicting works or works progressing without a granted Notice/Permit. By providing instructions for the co-ordination, preparation, and submission of notifications for Network Rail’s proposed works in the street/road.
Under the New Road and Street Works Act 1991 Section 60 (section 119 Scotland) imposes a duty on Statutory Undertakers of street works and relevant activities to co-operate with the Highways Authority/Roads Authority (RA) and others in this co-ordination, Network Rail is a Statutory Undertaker.
The New Roads and Street Works Act 1991 and Transport (Scotland) Act 2005(2019 when enacted) impose a duty on Highways Authority/Roads Authority to co-ordinate works and relevant activities on streets for which they are responsible.
These Acts impose a duty on Statutory Undertakers of street works and relevant activities to co-operate with the HA/RA and others in this co-ordination. Failure to co-operate can lead to a fine of up to £50,000 in Scotland.
